It\u2019s a critical accommodation for the 466 million people globally who are deaf or hard of hearing, and it\u2019s required by law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s discuss the major accessibility laws and lawsuits around captioning TV and movies so that your media is legally\u00a0<\/span><span style=\"font-weight: 400;\">compliant, and most importantly, accessible to all viewers.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><a class=\"btn btn-blue-blank\" href=\"https:\/\/go.3playmedia.com\/wp-fcc-bundle\" target=\"_blank\" rel=\"noopener noreferrer\">Essential Resources for FCC Closed Captioning Compliance<\/a><\/p>\n<p>&nbsp;<\/p>\n<h2><b>The CVAA<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The 21st Century Communications and Video Accessibility Act (CVAA) is a major accessibility law in the United States. Former President Barack Obama <\/span><a href=\"https:\/\/www.fcc.gov\/consumers\/guides\/21st-century-communications-and-video-accessibility-act-cvaa\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">signed the law in October 2010 to increase the access of modern communications<\/span><\/a><span style=\"font-weight: 400;\"> for people with disabilities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The CVAA applies to<\/span><a href=\"https:\/\/www.3playmedia.com\/2018\/08\/15\/everything-know-cvaa-guidelines-compliance\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\"> programs that previously aired on television<\/span><\/a><span style=\"font-weight: 400;\"> and are now online. According to the FCC, TV programs and movies must be captioned.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, the FCC provides quality standards for captioning across platforms. Although the FCC ruling applies solely to broadcasters, the FCC does state that quality standards for television closed captioning are of increasing importance because they dictate the standard for online video as well. Therefore, the FCC\u2019s quality standards not only impacts media broadcasters but streaming services as well.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The FCC\u2019s <\/span><a href=\"https:\/\/go.3playmedia.com\/wp-fcc\"><span style=\"font-weight: 400;\">four aspects of captioning quality<\/span><\/a><span style=\"font-weight: 400;\"> are accuracy, synchronicity, program completeness, and placement.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Caption accuracy: captions must include all words spoken in the order spoken &#8211; basically, no paraphrasing. Although they provide some stringent guidelines for closed captioning, they do allow for some leniency for live captions. It\u2019s a <\/span><a href=\"https:\/\/www.3playmedia.com\/2019\/02\/26\/ada-video-requirements\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">broad anti-discrimination act <\/span><\/a><span style=\"font-weight: 400;\">that protects individuals with disabilities from discrimination.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Title III of the ADA oversees places of public accommodation. These places include businesses like movie theaters, hotels, museums, restaurants, etc. Under Title III, no individual can be discriminated against on the basis of disability with regards to full and equal enjoyment of the goods and services at any place of public accommodation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When the law was passed, it was well before the internet was as widespread as it is today, therefore, it was always implied that the ADA solely applied to physical places, like brick and mortar businesses.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The ADA doesn\u2019t specify physical vs. digital places, so the law is open to interpretation. Netflix was significant because it was the first time the ADA had been interpreted for an online-only business.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Instead of taking the case to court, Netflix decided to settle and agreed to caption 100% of their videos indefinitely.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Following the settlement, Assistant Attorney General Thomas E. Perez had this to say about the shift in media consumption:\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><div class=\"su-quote su-quote-style-default su-quote-has-cite\"><div class=\"su-quote-inner su-u-clearfix su-u-trim\">Streaming of video programming over the Internet\u2014by defendant Netflix and other similar providers\u2014has revolutionized the entertainment industry; it is fast becoming the dominant means of delivering movies, television shows, and other entertainment offerings to the American public. Persons who are deaf or hard of hearing should not be prevented from fully participating in this aspect of American life. Netflix\u2019s denial of equal access to, and full enjoyment of, its \u201cWatch Instantly\u201d service violates the ADA.<span class=\"su-quote-cite\">Assistant Attorney General Thomas E. Perez<\/span><\/div><\/div>\n<p><span style=\"font-weight: 400;\">The other entertainment company sued for failing to caption their content was Time Warner Inc. and CNN. The advocacy group GLAD, otherwise known as the Greater Los Angeles Agency on Deafness, <\/span><a href=\"https:\/\/www.levelaccess.com\/netflix-and-cnn-com-sued-over-lack-of-captions\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">filed a lawsuit against Time Warner Inc.<\/span><\/a><span style=\"font-weight: 400;\">, the parent company of CNN.com. In the suit, the plaintiffs claimed that the videos on CNN.com weren\u2019t captioned and stated that the website discriminated against viewers with hearing loss.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to Reuters, many of the videos were accompanied by text, but they seldom matched the audio of the video and <\/span><a href=\"https:\/\/www.reuters.com\/article\/industry-us-netflix-lawsuit\/netflix-time-warner-sued-by-deaf-groups-idUSTRE75G6B020110617\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">the text wasn\u2019t a substitute for captioning<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These suits, and multiple others, go to show that captioning is essential for both broadcast and streaming media. Without closed captions, media companies could risk a potential lawsuit. Therefore, it\u2019s best to comply with the major laws.
