Harvard and NAD v. MIT lawsuits have officially been settled by the court of law.<\/strong><\/p>\n<h2>Behind the NAD v. Harvard and NAD v. MIT Lawsuits<\/h2>\n<p>For both the Harvard and MIT lawsuits, the NAD cited violations of the <a href=\"https:\/\/go.3playmedia.com\/wp-ada\" rel=\"noopener noreferrer\" target=\"_blank\">Americans with Disabilities Act (ADA)<\/a> and the <a href=\"https:\/\/go.3playmedia.com\/wp-section-508\" rel=\"noopener noreferrer\" target=\"_blank\">Rehabilitation Act<\/a>. The universities\u2019 alleged failure to provide appropriately accurate and comprehensive captioning for online course materials was the driving force behind the suit brought forth by the NAD.<\/p>\n<p>&nbsp;<br \/>\n<center><a href=\"https:\/\/go.3playmedia.com\/wp-ada\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"btn btn-blue-blank\">Learn More About the Americans with Disabilities Act \u2728<\/a><\/center><br \/>\n&nbsp;<\/p>\n<h3>Allegedly Inaccessible Content<\/h3>\n<p>Both Harvard and MIT provide free online programming, which includes videos and audio files for educational lectures and \u201ctopics of general interest.\u201d The universities also have extensive materials available for free on several online platforms, such as YouTube, iTunesU, Harvard@Home, and MIT OpenCourseWare. Both universities are the founding partners of edX, a nonprofit that offers dozens of MOOCs, or massive open online courses, free to students around the world.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.3playmedia.com\/wp-content\/uploads\/school-supplies-full-copy-2.png\" alt=\"backpack icon\" width=\"200\" align=\"left\" hspace=\"10\"\/><\/p>\n<p>In the NAD v. Harvard and NAD v. MIT lawsuits, the NAD claimed that Harvard and MIT denied people who are deaf and hard of hearing <strong>equal access to the universities\u2019 free online programming.<\/strong><\/p>\n<p>Notably, these lawsuits were the first of their kind to address the accuracy and quality of the captions provided. Much of the universities\u2019 online media is published on platforms like YouTube, whose <a href=\"https:\/\/www.3playmedia.com\/2014\/01\/10\/future-accessibility-video-captions-according-google-youtube\/\" rel=\"noopener noreferrer\" target=\"_blank\">auto-captioning function is woefully insufficient for the hard of hearing<\/a>.<\/p>\n<h3>Why Did the NAD Sue?<\/h3>\n<p>The NAD sued Harvard and MIT due to concerns that the universities were not providing equal access to online programming for students with disabilities, which is in direct violation of principles within accessibility laws. Ideally, a ruling from the courts would ensure that all content from the universities was made accessible to students with disabilities moving forward.<\/p>\n<p>In addition to ensuring accessibility for Harvard and MIT\u2019s online programming, a firm ruling from the courts would likely pressure other universities to comply with stricter captioning standards and also provide much-needed guidance for closed captioning and other web accessibility requirements.<\/p>\n<div style=\"background-color: #bee7f5; float: right; width: 220px; padding: 15px; margin: 10px 0 15px 15px!important;\">\n<h4>Deep Dive Into the ADA<\/h4>\n<p><a href=\"https:\/\/go.3playmedia.com\/wp-ada\"><\/a><br \/>\n<img decoding=\"async\" src=\"https:\/\/www.3playmedia.com\/wp-content\/uploads\/school-supplies-full-copy-4.png\" alt=\"plant\" width=\"175\" \/><\/p>\n<p><em>This brief examines the ADA through the lens of online video accessibility and provides insight into developments, resources, and guidance for online video accessibility.<\/em><\/p>\n<p><a href=\"https:\/\/go.3playmedia.com\/wp-ada\" class=\"btn btn-blue-blank\">Download the White Paper<\/a>\n<\/div>\n<h2>The Settlements<\/h2>\n<p>As of February 2020, the NAD v. Harvard and NAD v. MIT lawsuits have each settled through consent decrees.<\/p>\n<p><a href=\"https:\/\/www.nad.org\/2020\/02\/18\/landmark-agreements-establish-new-model-for-online-accessibility-in-higher-education-and-business\/\" rel=\"noopener noreferrer\" target=\"_blank\">According to the NAD<\/a>, both settlements represent \u201cthe most comprehensive set of online accessibility requirements in higher education and provide[s] a new model for ensuring worldwide online and digital accessibility in academia and business for people who are deaf and hard of hearing.\u201d<\/p>\n<h3>NAD v. Harvard Settlement<\/h3>\n<p>On November 27, 2019, after four years of litigation, both the <a href=\"https:\/\/www.3playmedia.com\/2019\/12\/03\/four-years-later-harvard-must-provide-closed-captions\/\" rel=\"noopener noreferrer\" target=\"_blank\">NAD and Harvard University came to a mutual agreement<\/a> through a <a href=\"https:\/\/creeclaw.org\/wp-content\/uploads\/2019\/11\/NAD-v-Harvard-Consent-Decree.pdf\" rel=\"noopener noreferrer\" target=\"_blank\">consent decree<\/a>. The settlement strengthened Harvard\u2019s new digital accessibility policy and was effective as of December 1, 2019.<\/p>\n<p>This settlement established set captioning guidelines so that Harvard University can continue to improve accessibility for its online resources for those who are deaf or hard of hearing.<\/p>\n<p>Though Harvard does and has been captioning much of its online content, this agreement \u201censures for the first time that the university will provide high-quality captioning services for online content.\u201d In fact, the terms of the agreement reference <a href=\"https:\/\/www.3playmedia.com\/2020\/01\/03\/harvard-settlement-3play-media-caption-quality\/\" rel=\"noopener noreferrer\" target=\"_blank\">3Play Media as a pillar for caption quality<\/a> and notes that captions must have \u201can accuracy rate equal to that offered by a vendor captioning service such as 3PlayMedia.\u201d<\/p>\n<h3>NAD v. MIT Settlement<\/h3>\n<p>On February 18, 2020, the NAD announced that it had reached a settlement with MIT in regards to the 2015 class-action lawsuit. The terms of the <a href=\"https:\/\/www.3playmedia.com\/2020\/02\/26\/nad-v-mit-settlement\/\" rel=\"noopener noreferrer\" target=\"_blank\">NAD v. MIT settlement<\/a> are similar to the agreement between the NAD and Harvard.<\/p>\n<p><a href=\"https:\/\/www.nad.org\/2020\/02\/18\/landmark-agreements-establish-new-model-for-online-accessibility-in-higher-education-and-business\/\" rel=\"noopener noreferrer\" target=\"_blank\">According to the NAD<\/a>, the settlement \u201cinstitutes a series of new guidelines to make the university\u2019s website and online resources accessible for people who are deaf and hard of hearing.\u201d<\/p>\n<h2>Harvard\u2019s and MIT\u2019s Stance on Accessibility<\/h2>\n<p><img decoding=\"async\" src=\"https:\/\/www.3playmedia.com\/wp-content\/uploads\/school-supplies-full-copy-3.png\" alt=\"eyeglassess icon\" width=\"300\" align=\"right\" \/><\/p>\n<p>In <a href=\"https:\/\/accessibility.huit.harvard.edu\/digital-accessibility-policy\" rel=\"noopener noreferrer\" target=\"_blank\">Harvard\u2019s online accessibility statement<\/a>, the university states its commitment to providing accessible online materials for all students. It continues to acknowledge accessibility as \u201cintegral to the academic and administrative work of the University.\u201d<\/p>\n<p><a href=\"https:\/\/www.mit.edu\/accessibility\/\" rel=\"noopener noreferrer\" target=\"_blank\">MIT\u2019s online accessibility statement<\/a> iterates that \u201cMIT is committed to providing an environment that is accessible to individuals with disabilities.\u201d<\/p>\n<p>3Play Media continues to work with MIT, Harvard, and edX to provide captioning and transcription services. For example, the <a href=\"https:\/\/www.3playmedia.com\/why-3play\/case-studies\/harvard-school-public-health\/\" rel=\"noopener noreferrer\" target=\"_blank\">Harvard School of Public Health added interactive transcripts<\/a> to online video material. MIT OpenCourseWare and other groups like MIT150 <a href=\"https:\/\/www.3playmedia.com\/why-3play\/case-studies\/mit150\/\" rel=\"noopener noreferrer\" target=\"_blank\">not only captioned their videos but also made them searchable to improve the learning experience<\/a> for all students.<\/p>\n<hr \/>\n<p>The outcomes of the NAD v. Harvard and NAD v. MIT lawsuits have set precedent to hold colleges and universities accountable for providing captioning for their online video content.
