Many accessibility laws were created before today\u2019s technological innovations, and it can be hard to keep up with relevant lawsuits.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In this blog, we&#8217;ll go over the legal requirements for live video and how providing live captioning can help you stay compliant.<\/span><\/p>\n<hr \/>\n<p style=\"text-align: center\"><span style=\"font-weight: 400\"><span class=\"su-highlight\" style=\"background:#DEEFF5;color:#000000\">&nbsp;<a href=\"https:\/\/go.3playmedia.com\/wp-ada\" target=\"_blank\" rel=\"noopener\">Discover which lawsuits support video accessibility \u27a1\ufe0f<\/a>&nbsp;<\/span><\/span><\/p>\n<hr \/>\n<h2><span style=\"font-weight: 400\">ADA Requirements for Live Captioning<\/span><\/h2>\n<p><span style=\"font-weight: 400\">Passed in 1990, the <\/span><span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/go.3playmedia.com\/wp-ada\" target=\"_blank\" rel=\"noopener\">Americans with Disabilities Act (ADA)<\/a><\/strong><\/span><span style=\"font-weight: 400\"> set landmark accessibility requirements that impact both private and public entities. While the ADA does not explicitly mention online or live video, it requires that \u201cauxiliary aids and services\u201d be made available to anyone with a disability to ensure <\/span><a href=\"https:\/\/www.ada.gov\/effective-comm.htm\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\"><span style=\"text-decoration: underline\"><strong>effective communication<\/strong><\/span><\/span><\/a><span style=\"font-weight: 400\">. Live captioning, also called real-time captioning or CART, is an example of an auxiliary aid for live events.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Under the ADA, captioning is required for:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">\u201cPublic entities,\u201d including state and local governments, in internal and external communications.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">\u201cPlaces of public accommodation,\u201d which are public or private businesses used by the public at large. Private clubs and religious organizations are exempt.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Numerous lawsuits set a legal precedent for video accessibility and live captioning. For example, the 2012 lawsuit <\/span><span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.3playmedia.com\/blog\/nad-v-netflix-ada-lawsuit-requires-closed-captioning-on-streaming-video\/\" target=\"_blank\" rel=\"noopener\">National Association of the Deaf v. Netflix<\/a><\/strong><\/span><span style=\"font-weight: 400\"> categorized Netflix, a purely virtual business, as a \u201cplace of public accommodation\u201d requiring closed captioning. <\/span><span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.3playmedia.com\/learn\/accessibility-lawsuits\/\" target=\"_blank\" rel=\"noopener\">While this lawsuit concerned closed captioning for pre-recorded content<\/a><\/strong><\/span><span style=\"font-weight: 400\">, other lawsuits have targeted live captioning.<\/span><\/p>\n<p>In 2006, <span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.washingtonpost.com\/archive\/local\/2006\/09\/20\/hearing-impaired-fans-sue-for-access-to-closed-captioning\/626ec3ff-84a4-49c5-8737-beb83f3e3123\/\" target=\"_blank\" rel=\"noopener\">the National Association of the Deaf (NAD)\u00a0 filed a lawsuit against the Washington Commanders<\/a><\/strong><\/span>, called the Washington Redskins at the time, for failing to provide captioning during games. The complaint requested live captioning on scoreboards and video monitors for all announcements, plays, and penalties called during the game.<\/p>\n<p><span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.nad.org\/2011\/03\/25\/deaf-washington-redskins-fans-win-stadium-access-case\/\" target=\"_blank\" rel=\"noopener\">The court ruled that the Washington Commanders needed to make all audio projected into the stadium bowl over the public address system accessible to deaf and hard-of-hearing fans.<\/a><\/strong><\/span> The court held that the ADA required the team to \u201cprovide auxiliary aids beyond assistive listening devices, which are useless to plaintiffs, to convey the: (1) game-related information broadcast over the public address system, including play information and referee calls; (2) emergency and public address announcements broadcast over the public address system; and (3) the words to music and other entertainment broadcast over the public address system.\u201d<\/p>\n<p>Additionally, the <span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.3playmedia.com\/blog\/harvard-mit-sued-captioning-violation-ada-rehabilitation-act\/\" target=\"_blank\" rel=\"noopener\">NAD sued MIT and Harvard<\/a><\/strong><\/span> for not providing captions, or providing inaccurate captions, for online educational videos. <span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/accessibility.mit.edu\/captioning\/mit-nad-agreement\" target=\"_blank\" rel=\"noopener\">Under the 2020 settlement<\/a><\/strong><\/span>, MIT agreed to not only provide captions for recorded content but also live captions for certain events that are streamed online. <span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/accessibility.huit.harvard.edu\/settlement-caption-requirements\" target=\"_blank\" rel=\"noopener\">Harvard also agreed<\/a><\/strong><\/span> to provide captions for recorded content and live captions for certain live-streamed events.<\/p>\n<h2><span style=\"font-weight: 400\">Rehabilitation Act (Section 508 and 508) Requirements for Live Captioning<img loading=\"lazy\" decoding=\"async\" class=\"size-thumbnail wp-image-25198 alignright\" src=\"https:\/\/www.3playmedia.com\/wp-content\/uploads\/Untitled-design-3-1-150x150.jpg\" alt=\"Briefcase, legal scale, and document on pink background\" width=\"150\" height=\"150\" \/><\/span><\/h2>\n<p><span style=\"font-weight: 400\">Enacted in 1973, the Rehabilitation Act originally addressed disability discrimination for federal entities or organizations receiving federal funding. <\/span><a href=\"https:\/\/go.3playmedia.com\/wp-section-508\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\"><span style=\"text-decoration: underline\"><strong>Sections 504 and 508<\/strong><\/span><\/span><\/a><span style=\"font-weight: 400\"> broadened the act\u2019s application to online and live video content.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Section 504 makes accessibility for disabled individuals a civil right. Failure to accommodate disabled individuals can result in a discrimination lawsuit, which applies to federal agencies and any entity receiving federal funding.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Section 508 mandates accessibility for electronic media or IT in federal programs or services. While this section doesn\u2019t explicitly extend beyond federal agencies, <\/span><a href=\"https:\/\/www.section508.gov\/manage\/laws-and-policies\/state\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\"><span style=\"text-decoration: underline\"><strong>many states passed laws<\/strong><\/span><\/span><\/a><span style=\"font-weight: 400\"> called <\/span><a href=\"https:\/\/www.3playmedia.com\/blog\/accessibility-laws-for-state-governments\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\"><span style=\"text-decoration: underline\"><strong>\u201cmini 508 laws\u201d<\/strong><\/span><\/span><\/a><span style=\"font-weight: 400\"> that extend the section\u2019s reach to organizations that receive federal funding.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Section 508 also requires compliance with <\/span><span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.3playmedia.com\/resources\/white-papers\/wp-wcag\/\" target=\"_blank\" rel=\"noopener\">WCAG 2.0 Level A and AA<\/a><\/strong><\/span><span style=\"font-weight: 400\"> success criteria, which means that pre-recorded video must have captions and audio description, and <\/span><b>live video must be live captioned.<\/b><\/p>\n<hr \/>\n<p style=\"text-align: center\"><span style=\"font-weight: 400\"><span class=\"su-highlight\" style=\"background:#DEEFF5;color:#000000\">&nbsp;<a href=\"https:\/\/go.3playmedia.com\/wp-ada\" target=\"_blank\" rel=\"noopener\">Learn how the ADA impacts video accessibility \u27a1\ufe0f<\/a>&nbsp;<\/span><\/span><\/p>\n<hr \/>\n<h2><span style=\"font-weight: 400\">WCAG Requirements for Live Captioning<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-thumbnail wp-image-25195\" src=\"https:\/\/www.3playmedia.com\/wp-content\/uploads\/2-7-150x150.jpg\" alt=\"Legal scale on computer screen\" width=\"150\" height=\"150\" \/><\/span><\/h2>\n<p><span style=\"font-weight: 400\">Aside from <\/span><a href=\"https:\/\/www.3playmedia.com\/learn\/accessibility\/accessibility-laws\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\"><span style=\"text-decoration: underline\"><strong>state and federal web accessibility laws<\/strong><\/span><\/span><\/a><span style=\"font-weight: 400\">, the most widely adopted and comprehensive technical standards have emerged from the <\/span><span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.3playmedia.com\/blog\/wcag-2-0-the-international-standard-for-web-accessibility-and-inclusive-design\/\" target=\"_blank\" rel=\"noopener\">W3C\u2019s Web Content Accessibility Guidelines (WCAG)<\/a><\/strong><\/span>.<\/p>\n<p><span style=\"font-weight: 400\">WCAG is a set of standards for making digital content accessible for all users, including people with disabilities. The guidelines:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Outline best practices for making web content universally perceivable, operable, understandable, and robust.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Define criteria for successful inclusive web design, with ascending levels of compliance (levels A, AA, and AAA).<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Are composed and reviewed by a global community of digital experts.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Connect the world through common information technology and user experience standards.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">WCAG 2.0 and 2.1 outline three levels of compliance. Level A is the highest priority and the easiest to achieve. Level AA is more comprehensive and the recommended standard for accessibility. Level AAA is the strictest, most comprehensive standard for accessible design.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Here are the <\/span><a href=\"http:\/\/www.w3.org\/TR\/UNDERSTANDING-WCAG20\/media-equiv.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\"><span style=\"text-decoration: underline\"><strong>WCAG compliance levels for accessible video and synchronized media<\/strong><\/span><\/span><\/a><span style=\"font-weight: 400\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Level A: (1.2.2) Captions are provided for all pre-recorded audio content in synchronized media, except when the media is a media alternative for text and is clearly labeled as such.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Level AA: (1.2.4) In addition to Level A compliance, captions are provided for all live audio content in synchronized media.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Level AAA: (1.2.6) In addition to Levels A and AA compliance, sign language interpretation is provided for all pre-recorded audio content in synchronized media.<\/span><b>\u00a0<\/b><\/li>\n<\/ul>\n<p><strong>Since WCAG Level AA is the recommended standard for accessibility, live video content must be live captioned.<\/strong><\/p>\n<h2><span style=\"font-weight: 400\">Live Professional Captions vs. Live Auto Captions for Compliance<\/span><\/h2>\n<p><span style=\"font-weight: 400\">When considering legal compliance and accommodations, it\u2019s imperative to distinguish between <\/span><span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.3playmedia.com\/blog\/live-auto-captions-vs-live-professional-captions-which-is-right-for-you\/\" target=\"_blank\" rel=\"noopener\">live auto-captioning and live professional captioning<\/a><\/strong><\/span><span style=\"font-weight: 400\">. <\/span><\/p>\n<p><span style=\"font-weight: 400\">According to the W3C, <\/span><a href=\"https:\/\/www.w3.org\/WAI\/media\/av\/captions\/#automatic-captions-are-not-sufficient\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\"><span style=\"text-decoration: underline\"><strong>automatic captions are not sufficient for meeting user needs or accessibility requirements<\/strong><\/span><\/span><\/a><span style=\"font-weight: 400\"> unless they are confirmed to be entirely accurate, <\/span><span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.3playmedia.com\/blog\/the-human-touch-in-live-captioning-ensures-accuracy-accessibility\/\" target=\"_blank\" rel=\"noopener\">which is rarely the case<\/a><\/strong><\/span><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">We can apply the same logic to live captioning.<\/span><\/p>\n<p><span style=\"font-weight: 400\">While event hosts can choose live auto-captioning, which uses Automatic Speech Recognition (ASR) technology, this option is rarely accurate enough to be considered an appropriate accommodation for deaf or hard-of-hearing viewers.
