According to Forrester Research, employees are <span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.panopto.com\/blog\/5-facts-you-can-use-to-make-the-case-for-video-in-your-learning-development-organization\/\" target=\"_blank\" rel=\"noopener noreferrer\">75% more likely to watch a video than to read documents, emails, or web articles.<\/a><\/strong><\/span><\/span><\/p>\n<p><span style=\"font-weight: 400\">This blog will discuss the legal requirements for making corporate training videos accessible, the benefits of captioning company videos, and valuable tools to increase engagement.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Legal Requirements for Captioning Corporate Training Videos<\/span><\/h2>\n<p><span style=\"font-weight: 400\">The Americans with Disabilities Act (ADA) requires private companies to caption their content. Undue hardship can refer to financial difficulty and accommodations that are incredibly substantial, disruptive, or would fundamentally alter the nature or operation of the business. Employers typically make case-by-case basis judgment calls on whether a specific reasonable accommodation would cause undue hardship.<\/span><\/p>\n<p><span style=\"font-weight: 400\">If a specific accommodation is deemed an undue hardship, employers are expected to try to find another accommodation that can be made without hardship.<\/span><\/p>\n<h3><span style=\"font-weight: 400\">EEOC v. FedEx<\/span><\/h3>\n<p><span style=\"font-weight: 400\">In 2014, the <\/span><span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/www.eeoc.gov\/newsroom\/fedex-ground-pay-33-million-settle-eeoc-disability-discrimination-lawsuit-0\" target=\"_blank\" rel=\"noopener\">U.S. Equal Employment Opportunity Commission (EEOC) sued FedEx<\/a><\/strong><\/span><span style=\"font-weight: 400\"> for failing to provide captions and sign language interpreters for in-person training and training videos in the following situations:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Mandatory initial tour of facilities<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">New-hire orientation applicants<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Staff meetings<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Performance meetings<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Safety meetings<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">This was a clear violation of the ADA, and the courts agreed.<\/span><\/p>\n<p><span style=\"font-weight: 400\">With an annual revenue well into the billions, FedEx could not prove that providing captions and sign language interpretation were \u201cundue burdens\u201d to the company.
