Harris, and Eliza Hittman <\/span><a href=\"https:\/\/variety.com\/2023\/film\/news\/sundance-jury-walks-out-magazine-dreams-premiere-festival-marlee-matlin-captioning-1235497789\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">walked out of a film screening<\/span><\/a><span style=\"font-weight: 400;\"> after Matlin\u2019s closed captioning device malfunctioned and no other captioning alternatives were available to her and other d\/Deaf and hard of hearing audience members.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Before this incident at Sundance, the issue of closed captioning at movie theaters and festivals had long been debated by filmmakers and viewers alike. Many in the d\/Deaf and hard of hearing communities have called for film screenings to include permanent, burned-in open captions. The current closed captioning solution for film screenings relies on captioning devices, which are often plagued with technological and user experience issues.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But what exactly are open captions, and why are accessibility advocates passionate about adding them to films screened at movie theaters and festivals?\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this blog, we\u2019ll discuss the current state of closed captions at movie theaters and festivals; why accessibility advocates are calling on the <\/span><a href=\"https:\/\/www.3playmedia.com\/why-3play\/industries\/cinematic\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">media and entertainment industry<\/span><\/a><span style=\"font-weight: 400;\"> to move toward open captioning for films; and discuss artistic, cost, and audience loss concerns many filmmakers have about adding open captions to movies.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">The State of Closed Captions at Movie Theaters and Film Festivals<\/span><\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-28923 size-full\" src=\"https:\/\/www.3playmedia.com\/wp-content\/uploads\/2023\/02\/31-e1675801800877.jpg\" alt=\"Cinema entrance\" width=\"500\" height=\"331\" \/><\/p>\n<h3><span style=\"font-weight: 400;\">ADA Requirements for Movie Theaters<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Movie theaters are required to provide and maintain closed captioning and <\/span><a href=\"https:\/\/www.3playmedia.com\/services\/audio-description\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">audio description<\/span><\/a><span style=\"font-weight: 400;\"> equipment for digital films that are produced with accessibility features, according to a <\/span><a href=\"https:\/\/archive.ada.gov\/regs2016\/movie_captioning_rule_page.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Final Rule<\/span><\/a><span style=\"font-weight: 400;\"> revising the <\/span><a href=\"https:\/\/go.3playmedia.com\/wp-ada\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Americans with Disabilities Act<\/span><\/a><span style=\"font-weight: 400;\"> (ADA) Title III.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Additionally, theaters are required to provide notice to the public about the availability of accessibility features and ensure that staff is available to assist patrons with equipment.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">How Movie Theater Closed Captioning Devices Work<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.nad.org\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">National Association of the Deaf<\/span><\/a><span style=\"font-weight: 400;\"> (NAD) states that the two types of captioning equipment available in theaters are <\/span><a href=\"https:\/\/www.nad.org\/resources\/technology\/caption-access-in-movie-theaters\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Sony Entertainment Access Glasses and CaptiView<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n<h4><span style=\"font-weight: 400;\">Sony Entertainment Access Glasses<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">Captions are transmitted to a wearable wireless receiver device, which viewers wear while watching a film. Captions appear overlaid on the screen through the lenses.<\/span><\/p>\n<h4><span style=\"font-weight: 400;\">CaptiView\u00a0<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">A small display with a flexible arm is attached to the arm of the seat or cupholder. Captions are transmitted to the device and appear on the display screen.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">The Closed Captioning User Experience at Theaters and Festivals<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Many accessibility advocates and people who use closed captioning find the user experience of captioning devices in their current state difficult. In the last year alone, multiple disabled people who use captioning devices have lamented the poor user experience of the current technology, including <\/span><a href=\"https:\/\/variety.com\/2023\/film\/opinion\/sundance-open-captions-movies-access-1235498714\/?hss_channel=lcp-251283\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">filmmaker Alison O\u2019Daniel<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/livingwithhearingloss.com\/2022\/06\/28\/the-joy-of-open-captions-at-the-movies\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">advocate Shari Eberts<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To get further insight into the captioning issues at movie theaters and film festivals, we chatted with <\/span><a href=\"https:\/\/www.linkedin.com\/in\/matt-lauterbach-9108238\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Matt Lauterbach<\/span><\/a><span style=\"font-weight: 400;\">, a filmmaker and accessibility advocate who founded <\/span><a href=\"https:\/\/www.allsensesgo.com\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">All Senses Go<\/span><\/a><span style=\"font-weight: 400;\"> and serves as <\/span><a href=\"https:\/\/reelabilities.org\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ReelAbilities Film Festival<\/span><\/a><span style=\"font-weight: 400;\"> Co-Director in Chicago.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lauterbach said that \u201ca lot of what\u2019s happening is intentions that aren\u2019t yet matched by an understanding of what\u2019s involved\u201d when it comes to accessibility at film festivals and movie theaters. He noted that filmmakers generally want to reach a universal audience and be accessible to all but are facing technological and procedural constraints to get to the point where films are truly accessible. In the meantime, closed captions remain a way for filmmakers and theaters to provide a compliant solution without taking a \u201cvisible stand\u201d on the issue.<\/span><\/p>\n<div class=\"su-quote su-quote-style-default su-quote-has-cite\">\n<div class=\"su-quote-inner su-u-clearfix su-u-trim\">Open captions are a visual stand [for inclusion].<span class=\"su-quote-cite\">Matt Lauterbach<\/span><\/div>\n<\/div>\n<p><span style=\"font-weight: 400;\">Lauterbach works with many filmmakers and caption users who support the use of open captions over closed captioning devices in movie theaters and film festivals. He explained that <\/span><b>captioning technology can be cognitively draining, straining on the eyes, and even cause users to miss content in screenings due to the need to look back and forth from a device to the screen. <\/b><span style=\"font-weight: 400;\">\u201cIt\u2019s a tough user experience,\u201d he said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Besides the user experience, Lauterbach also noted some basic technological functions in captioning devices that are prone to disrupt users.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe device needs to be set to the proper theater,\u201d he said. \u201cYou might get a caption device set to theater 7, and it\u2019s set to theater 6. You then need to bring it back to get it fixed [during the movie]. That\u2019s tough.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On top of incorrect theater settings, dead batteries and uncharged devices are a common issue, not to mention theater and festival staff who aren\u2019t trained on how to use or troubleshoot captioning devices.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Why Accessibility Advocates Want Open Captions<\/span><\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-28924\" src=\"https:\/\/www.3playmedia.com\/wp-content\/uploads\/2023\/02\/32-e1675801826849-300x280.jpg\" alt=\"Accessibility symbol\" width=\"400\" height=\"373\" \/><\/p>\n<p><span style=\"font-weight: 400;\">When it comes to captioning at movie theaters and film festivals, many accessibility advocates and disabled users have aligned on adding open captioning to all screenings. Open captions, similar to burned-in SDH subtitles, provide a permanently accessible way to view dialogue and sound effects on screen. Advocates prefer open captions over closed captions for film screenings due to their more inclusive user experience.<\/span><\/p>\n<div id=\"\" class=\"su-box su-box-style-default\" style=\"border-color: #b3003c; border-radius: 5px;\">\n<div class=\"su-box-title\" style=\"background-color: #e6006f; color: #ffffff; border-top-left-radius: 3px; border-top-right-radius: 3px;\">What are Open Captions and How Do They Work?<\/div>\n<div class=\"su-box-content su-u-clearfix su-u-trim\" style=\"border-bottom-left-radius: 3px; border-bottom-right-radius: 3px;\"><a href=\"https:\/\/www.3playmedia.com\/services\/features\/open-captioning\/\" target=\"_blank\" rel=\"noopener\">Open captions<\/a> are permanently burned into a video so that the viewer cannot turn them off. Because open captions are part of a video, they are supported by all video players and devices. Open captions eliminate rendering inconsistencies across different video players and devices.<\/div>\n<\/div>\n<p><a href=\"https:\/\/variety.com\/2023\/film\/news\/sundance-jury-walks-out-magazine-dreams-premiere-festival-marlee-matlin-captioning-1235497789\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">According to <\/span><i><span style=\"font-weight: 400;\">Variety<\/span><\/i><\/a><span style=\"font-weight: 400;\">, many international film festivals, including Cannes and Venice, already include open captions or subtitles in multiple languages on the screen, and Sundance\u2019s 2023 dramatic jury \u201crepeatedly expressed concerns to both Sundance and filmmakers that movies playing at this year\u2019s festival should come with open captions.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Open captioning for movies has become more mainstream in the last few years, with some theaters and filmmakers adopting the practice to make films more inclusive for d\/Deaf and hard of hearing viewers:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In 2021, <\/span><a href=\"https:\/\/www.npr.org\/2021\/10\/21\/1048017853\/amc-theatres-open-captioning-movie-accessibility\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">AMC Theatres added open captioning<\/span><\/a><span style=\"font-weight: 400;\"> to select showings in over 100 U.S. markets.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Also in 2021, Minneapolis-based independent movie theater St. Anthony Main Theatre became <\/span><a href=\"https:\/\/www.dailymoth.com\/blog\/minneapolis-cinema-first-in-nation-to-offer-open-captions-for-all-showtimesnbsp\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">the first cinema in the U.S. to provide open captions on all of its screenings<\/span><\/a><span style=\"font-weight: 400;\"> before it changed ownership and <\/span><a href=\"https:\/\/www.kare11.com\/article\/news\/local\/breaking-the-news\/minneapolis-woman-advocates-for-open-captions-at-msp-film-at-the-main\/89-476e2928-3762-450c-99f2-f60de058b9d3\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">replaced open captioning with closed captioning devices<\/span><\/a><span style=\"font-weight: 400;\"> the following year.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In 2022, Best Picture winner <\/span><a href=\"https:\/\/www.3playmedia.com\/blog\/coda-film-dominates-wins-all-three-academy-award-nominations\/\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">CODA<\/span><\/i><\/a> <span style=\"font-weight: 400;\">was <\/span><a href=\"https:\/\/www.wsj.com\/articles\/on-screen-captions-for-oscar-winning-coda-spark-calls-for-more-accessible-theater-experiences-11648480407\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">distributed with open captions<\/span><\/a><span style=\"font-weight: 400;\"> for its theatrical release, which Matlin noted was done to <\/span><a href=\"https:\/\/variety.com\/2023\/film\/festivals\/marlee-matlin-open-captioned-films-sundance-1235501068\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ensure inclusion for all<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Several lawmakers across the U.S. have also introduced or passed bills requiring theaters to provide open captioning on a portion of screenings in places like <\/span><a href=\"https:\/\/www.wsj.com\/articles\/on-screen-captions-for-oscar-winning-coda-spark-calls-for-more-accessible-theater-experiences-11648480407\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">the District of Columbia, New York City, Hawaii<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/whyy.org\/articles\/making-movies-more-accessible-delaware-cinemas-now-offer-films-with-open-captions\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Delaware<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><a class=\"btn btn-blue-blank\" href=\"https:\/\/go.3playmedia.com\/wp-caption-reformatting-checklist\" target=\"_blank\" rel=\"noopener noreferrer\">Do you need to update your existing caption files? Some filmmakers and viewers find open captions to be too costly or distracting. Even Lauterbach admits that there are \u201clegitimate artistic concerns\u201d when it comes to open captions on films.\u00a0<\/span><\/p>\n<div class=\"su-quote su-quote-style-default su-quote-has-cite\">\n<div class=\"su-quote-inner su-u-clearfix su-u-trim\">[It] depends on what you as a venue want to value. Film festivals are less profit-motivated and often have inclusive missions. To really practice what they are preaching, I think open captions are one of the strongest symbols you can send.<span class=\"su-quote-cite\">Matt Lauterbach<\/span><\/div>\n<\/div>\n<p><span style=\"font-weight: 400;\">Some creators, particularly disabled filmmakers, strongly believe in the benefits of open captioning and make it part of their art rather than an obligatory element. For example, filmmaker Alison O\u2019Daniel\u2019s 2023 Sundance debut, <\/span><a href=\"https:\/\/festival.sundance.org\/program\/film\/638a190fd406b26d22f2cfca\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">The Tuba Thieves<\/span><\/i><\/a><i><span style=\"font-weight: 400;\">,<\/span><\/i> <a href=\"https:\/\/variety.com\/2023\/film\/opinion\/sundance-open-captions-movies-access-1235498714\/?hss_channel=lcp-251283\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">includes open captions specifically crafted to be part of the art itself<\/span><\/a><span style=\"font-weight: 400;\">. Additionally, the use of certain types of <\/span><a href=\"https:\/\/www.3playmedia.com\/blog\/sdh-subtitles-non-sdh-subtitles-when-to-use-them\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">SDH subtitles<\/span><\/a><span style=\"font-weight: 400;\"> can support numerous customizations so that filmmakers and producers can curate the look and feel of the subtitles to align with a film\u2019s other artistic elements.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For filmmakers with open captioning concerns, the issue is less about intentional exclusion and rather one about production costs and viewer experience. But are these concerns legitimate?<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Cost<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The issue of cost for the creation of an open-captioned print of a film is often cited by filmmakers as a barrier to offering open captions.
